ONLINE TRAINING TERMS & CONDITIONS
By accepting this agreement, you ("Client") agree to purchase online training from Jayne Tancred / jaynetancred.com.au ("Service Provider") (as specified by Client at the time of purchase), and agree to the terms and conditions as set forth in this Agreement.
Most of Jayne Tancred’s training programs require upfront payment, however, payment plans may be made available from time to time. Payment terms are as follows:
Upfront payment: A single payment is required at the time of enrolling in the program. Participation in the training program will not commence until payment is received in full.
Instalment plans: Payments will be debited from Client’s nominated bank account on a regular basis. The initial fee will be due at the time of enrolment, and subsequent fees will be debited on a recurring schedule agreed at the time of enrolment. Participation in the training program requires all payments to be up to date.
It is an essential precondition of participating in the online training that you agree and accept that Service Provider is not legally responsible for any loss or damage you might suffer related to your use of created content and strategy, whether from errors or from omissions in our documents or information, or from any goods or services Service Provider may offer. This includes your use or reliance on any third-party content, links, comments or advertisements. Your use of, or reliance on, any information or materials provided directly to you or on this website is entirely at your own risk, for which Service Provider shall not be liable.
It is Client’s responsibility to ensure that any training, products, services or information shared with you or available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.
Content shared by Service Provider during the online training (including but not limited to frameworks, processes, designs, diagrams, video, audio and written content) remain the intellectual property of Service Provider and are copyright of Jayne Tancred, with all rights reserved. However, Client may continue to use supplied material indefinitely for personal and non-commercial use. Any redistribution or reproduction of part or all of the contents in any form is prohibited other than that you may print or download contents to a local hard disk for your personal and non-commercial use only. You may not, except with our express written permission, sell, distribute or commercially exploit the content, or create any derivative work based on the content. You may not transmit it or store it on any other website or other form of electronic retrieval system.
Both parties agree that they will keep any business information received in the course of the training program confidential.
Client understands that from time to time, written statements, images, audio recordings or video recordings of Client while participating in the training program and made on behalf of the Service Provider may be used in connection with publicising and promoting the Service Provider. Client authorises the Service Provider to use their name, brief biographical and business information, logo, and written or recorded statements, on the proviso that commercially sensitive or confidential information is not shared.
Due to the digital nature of online training programs, bookings are non-refundable. However, if you become unable to participate in a program due to reasons beyond your control, you are able to receive a credit for the full amount paid to use towards a future program or service, provided you give us at least 7 days notice before the program starts. Credits will be valid for 12 months.
Service Provider reserves the right to reschedule live training sessions to an alternative date in the event of ill health or personal emergency.
The above Services come with guarantees that cannot be excluded, modified or restricted under the Australian Consumer Law and are in addition to any manufacturer or supplier warranty. For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), Service Provider’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.
You must be over 18 years of age to use this website and to purchase any goods or services.
This agreement and this website are subject to the laws of NSW and Australia. If there is a dispute between you and Service Provider that results in litigation then you must submit to the jurisdiction of the courts of NSW.
